Terms of Service

1. The service
LotHours provides workforce management software for car dealerships including time tracking, internal team messaging, and one-way SMS notifications to employees who opt in (“the service”).
2. Accounts
You must provide accurate information and keep credentials secure. You’re responsible for activity under your account. You must be at least 18 to create an org account.
3. Subscription and payment
Pro and Enterprise plans are billed per site. The 14-day Pro trial does not require payment. After the trial, your subscription auto-renews monthly until canceled. Cancel anytime from the billing portal — you keep access until the period ends.
4. Employee SMS responsibilities
Employee SMS notifications are transactional only — clock reminders, shift and cover alerts, and attendance coordination (sick / late / break / back-from-break). They are opt-in by each individual employee, and an employer must not enroll an employee’s mobile number without that employee’s own consent. You agree not to use SMS for marketing, advertising, or unrelated promotions, and to honor STOP requests promptly. Recipients can opt out at any time by replying STOP, get help by replying HELP, and opt back in by replying START. You are responsible for obtaining and maintaining valid consent for each enrolled number and for complying with the TCPA, CTIA guidelines, and carrier (A2P 10DLC) requirements. 5. Email communications
LotHours sends transactional email (such as invites, authentication, and account notices) that is necessary to operate your account. Any commercial or promotional email we send will, consistent with the CAN-SPAM Act, identify the sender accurately, use truthful and non-deceptive subject lines and header information, include a valid physical postal address, and provide a clear way to unsubscribe; we will honor unsubscribe requests promptly. You agree not to use LotHours to send unlawful, deceptive, or unsolicited bulk email, and to comply with CAN-SPAM and any other applicable email and anti-spam laws when you communicate through the service.
6. Acceptable use
No illegal use. No reverse engineering, scraping, or attempting to circumvent access controls. No use that disrupts other customers.
7. Data ownership
Your dealership owns its data. We act as a processor. You can export data anytime; we’ll delete it within 30 days of account closure (subject to retention requirements in our Privacy Policy).
8. Mobile apps
The LotHours mobile apps are licensed, not sold. The license is non-exclusive and revocable. App Store and Google Play terms apply to your install.
9. Service availability
We strive for 99.9% uptime but make no guarantee. Scheduled maintenance announced when feasible.
10. Disclaimer and limitation
The service is provided “as is” without warranties. To the fullest extent permitted by law, our liability is capped at the fees you paid us in the 12 months preceding any claim.
11. Termination
Either side can terminate for material breach with 30 days’ notice. We can terminate immediately for non-payment or violation of acceptable use.
12. Governing law
State of California, USA. Disputes resolved in San Diego County.
